Important Exceptions & Edge Cases

765 ILCS 715/1: Landlords of 25+ unit properties must pay interest on security deposits held 6+ months. Rate = minimum passbook savings rate of largest IL commercial bank as of Dec 31 of preceding year. Must pay within 30 days after each 12-month rental period.

Chicago RLTO § 5-12-080: Chicago has significantly stricter rules. Must hold in federally insured interest-bearing account. Must provide receipt with bank name/address. 2x penalty + attorney fees for violations. Separate ordinance from state law — ALWAYS check if property is in Chicago.
